This is for those who are in removal proceedings before an immigration judge. You must file Form I-589 with the immigration court. 

Key steps for applying

• Obtain and complete Form I-589: 
Download and fill out the Application for Asylum and for Withholding of Removal from USCIS. You can include your spouse and unmarried children under 21 as dependents.

• Gather evidence: 
Collect evidence to support your claim of persecution, such as news articles, government documents, or personal experiences with threats and detention. 

• File your application: 
File the application with USCIS (for affirmative asylum) or the immigration court (for defensive asylum). 

• Attend an interview: 
After filing, you will likely have an interview with a USCIS asylum officer.
